SECOND READING AND ADOPTIIOJN <br />Ord No. 0-08-09 Date 01119110 Item No. 44 <br />STAFF REPORT 8 <br />ITEM NO. <br />DATE: DECEMBER 15, 2009 <br />TO: MAYOR AND CITY COUNCII.C/--i�� <br />FROM: ROD FOSTER, CITY MANAGER <br />PREPARED BY: CANDACE CASSEL, ECONOMIC DEVELOPMENT DIRECTOR <br />SUBJECT: APPROVAL OF A ZONE TEXT AMENDMENT TO VARIOUS PROVISIONS <br />TITLE 18 OF THE COLTON MUNICIPAL CODE TO INCLUDE A <br />MODIFIED DEFINITION RELATED TO BEER AND WINE SALES, AND <br />TO REQUIRE A CONDITIONAL USE PERMIT FOR ANY PREMISES <br />ENGAGED IN THE SALE OF BEER, WINE AND OTHER ALCOHOLIC <br />BEVERAGES FOR ON -PREMISES OR OFF -PREMISES CONSUMPTION. <br />RECOMMENDED ACTION <br />It is recommended that the City Council approve the amendment of various provisions Title 18 of <br />the Colton Municipal Code to include a modified definition related to beer and wine sales, and to <br />require a conditional use permit for any premises engaged in the sale of beer, wine and other <br />alcoholic beverages for on -premises or off -premises consumption. <br />GOAL STATEMENT <br />The proposed action will support the City's goal to provide a balance of commercial land uses <br />(General Plan, General Objective #1) and to meet population growth needs while preventing <br />commercial over saturation (General Plan, Commercial Principle #1). <br />BACKGROUND <br />The proposed Zone Text Amendment would require establishments engaged in the sale of beer, <br />wine and other alcoholic beverages for on and off site consumption to obtain a Conditional Use <br />Permit from the City of Colton. The amendment also proposes a new definition of Alcohol <br />Beverage Sales and a modified definition of Beer and Wine Sales in the City of Colton. Staff <br />
