R-05-10 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />APPROVING THE SIDE LETTER TO THE CONTRACT WITH THE MID - <br />MANAGER UNIT OF THE SAN BERNARDINO PUBLIC EMPLOYEES <br />ASSOCIATION AND ADDING THE CITY STAFF POSITION OF CHIEF DEPUTY <br />CITY CLERK TO THE EXECUTIVE BARGAINING UNIT <br />WHEREAS, the City of Colton has a valid contract with the Mid -Manager <br />Unit of the San Bernardino Public Employees Association, and; <br />WHEREAS, within this current contract, the City staff position of Chief <br />Deputy City Clerk is represented by the Mid -Manager Unit of the San Bernardino Public <br />Employees Association, and; <br />WHEREAS, the City desires to move this position into the Executive <br />Bargaining Unit to ensure the status of the position as a confidential employee, and; <br />WHEREAS, the Mid -Manager Unit of the San Bernardino Public Employees <br />Association has agreed to modify this unit, per Side Letter to the current Memorandum of <br />Understanding, and eliminate the position of the Chief Deputy City Clerk from the list of <br />represented employees within this bargaining unit. <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF <br />COLTON DOES HEREBY RESOLVE AS FOLLOWS: <br />SECTION 1: The Side Letter between the City of Colton and the Mid - <br />Manager Unit of the San Bernardino Public Employees Association, included as Exhibit A, <br />is approved, modifying this unit and eliminating the City staff position of Chief Deputy <br />City Clerk as a represented position within this bargaining unit, and; <br />SECTION 2: The City staff position of Chief Deputy City Clerk shall be <br />added to the list of positions represented by the Executive Bargaining Unit. <br />PASSED, APPROVED AND ADOPTED this 2nd day of February, 2010. <br />ATTEST: <br />EILEEN C.
