Staff Report to the Mayor and City Council <br />HOME Grant Application <br />April 20, 2010 <br />Page 3 <br />If Council is in support of the application, staff will begin a process of negotiating details of a <br />working relationship with CBH. That process will include executing an Exclusive Negotiation <br />Agreement (ENA) with CBH, enabling them to work on the City's behalf to secure funding for <br />the project from various federal and state funding sources and to work with the City to design <br />and determine amenities that will be included in the project. Following an ENA, if directed by <br />Council, staff will work toward an acceptable Disposition and Development Agreement (DDA) <br />with CBH, which will describe issues such as the structure and terms of the disposition and <br />predisposition requirements; the development schedule and construction requirements; the use, <br />operating and maintenance requirements of both parties and the permitted encumbrances. In <br />addition, performance assurances and terms and remedies in the event of default are addressed. <br />Both an ENA and a DDA require approval by the City Council before execution. <br />FISCAL IMPACTS <br />The request for support of the application for HOME funds will not obligate the City to expend <br />any money at this time. Approval of the application by the County of San Bernardino may result <br />in securing approximately $1.9 million for development of affordable senior housing. <br />ALTERNATIVES <br />Provide alternative direction to staff. <br />ATTACHMENTS <br />None <br />
