ITEM NO. -7 <br />STAFF REPORT <br />oft TED <br />DATE: AUGUST 3, 2010 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: ROD FOSTER, CITY MANAGER <br />PREPARED BY: DEAN DERLETH, CITY ATTORNEY <br />PIERO DALLARDA, DEPUTY CITY ATTORNEY <br />SUBJECT: INSTITUTIONAL CONTROLS GROUNDWATER MANAGEMENT <br />PROGRAM AGREEMENT (ICGMPA) <br />RECOMMENDED ACTION <br />It is recommended that the City Council approve the Institutional Controls Groundwater <br />Management Program Agreement (ICGMPA), and as part of that approval consent to the <br />extension of the interim Agreement to Develop and Adopt an Institutional Controls Groundwater <br />Management Program until the effective date of the ICGMPA. <br />GOAL STATEMENT <br />The proposed action will support the City's goal of managing its water supply in an efficient and <br />effective manner, partly through the cooperative efforts of other regional entities. <br />DISCUSSION <br />The following is some background information regarding the proposed ICGMPA. <br />In or about 2003, the City of San Bernardino and the California Department of Toxic Substances <br />Control filed two separate lawsuits in federal court against the United States. The lawsuits <br />involved two plumes (Muscoy and Newmark) that carried TCE (trichloroethylene) and PCE <br />(tetrachlorethylene), and contaminated the water supply in the Bunker Hill Basin (the 'Basin"). <br />Although the source of contamination has not been conclusively identified, there is strong <br />evidence that the plumes were the result of activities by the U.S. Army during WWII. <br />Many public and private entities rely on the Bunker Hill Basin as a source of water supply, <br />including the City of Colton ("City"), which operates wells in the area. The Basin is also used <br />for recharge/storage by a series of public entities. <br />The Basin has been the subject of water rights adjudication cases in state court, and the City has <br />certain water rights pursuant to a judgment in one of the cases.
