be subject to all ordinances and regulations of the City, the County of San Bernardino <br />and all other public agencies which are applicable to properties located within the City. <br />SECTION 9. NOTICES UNDER AGREEMENT. Notices required under this <br />Agreement shall be sufficient if in writing and either served personally upon the parties <br />to whom they are directed or by deposit in the United States mail, postage prepaid, <br />certified, return receipt requested, addressed to the following: <br />A. City: City Clerk <br />City of Colton <br />650 N. La Cadena Dr. <br />Colton, CA 92324 <br />B. Property Shareef Awad, S&S Investment Inc. <br />Owner: <br />1231 N Cactus Ave, Suite D <br />Rialto, CA 92376 <br />SECTION 10: AUTHORITY; TERMINATION. This Agreement is entered into <br />pursuant to authority granted to the City in California Government Code Section <br />56133(a). This Agreement shall terminate with the written consent of both parties or in <br />the event Property is annexed to the City. <br />SECTION 11. ASSIGNMENT. This Agreement shall be binding upon the parties, <br />their heirs, successors and assigns when executed and need not be recorded. Property <br />Owner shall have the right to assign its rights, duties and obligations under this <br />Agreement to Successors of Property. No additional sanitary sewer connections are <br />permitted per this Agreement. <br />SECTION 12. MODIFICATION. This Agreement may be modified only by a <br />subsequent written agreement executed by all parties. <br />SECTION 13. ATTORNEYS' FEES. Should the parties commence litigation <br />and/or arbitration to enforce the provisions of this Agreement, the prevailing party shall <br />be entitled to receive the costs of such litigation or arbitration including attorneys' fees. <br />SECTION 14. INTEGRATION. This Agreement represents the entire <br />understanding between the City and Property Owner as to those matters contained <br />herein, and supercedes and cancels any prior oral or written understandings, promises <br />or representations with those matters covered hereunder. <br />[SIGNATURES TO FOLLOW ON NEXT PAGE] <br />
