be subject to all ordinances and regulations of the City, the County of San Bernardino and all other public agencies which are applicable to properties located within the City. SECTION 9. NOTICES UNDER AGREEMENT. Notices required under this Agreement shall be sufficient if in writing and either served personally upon the parties to whom they are directed or by deposit in the United States mail, postage prepaid, certified, return receipt requested, addressed to the following: A. Owner: 1231 N Cactus Ave, Suite D Rialto, CA 92376 SECTION 10: AUTHORITY; TERMINATION. This Agreement is entered into pursuant to authority granted to the City in California Government Code Section 56133(a). This Agreement shall terminate with the written consent of both parties or in the event Property is annexed to the City. SECTION 11. ASSIGNMENT. This Agreement shall be binding upon the parties, their heirs, successors and assigns when executed and need not be recorded. Property Owner shall have the right to assign its rights, duties and obligations under this Agreement to Successors of Property. No additional sanitary sewer connections are permitted per this Agreement. SECTION 12. MODIFICATION. This Agreement may be modified only by a subsequent written agreement executed by all parties. SECTION 13. ATTORNEYS' FEES. Should the parties commence litigation and/or arbitration to enforce the provisions of this Agreement, the prevailing party shall be entitled to receive the costs of such litigation or arbitration including attorneys' fees. SECTION 14. INTEGRATION. This Agreement represents the entire understanding between the City and Property Owner as to those matters contained herein, and supercedes and cancels any prior oral or written understandings, promises or representations with those matters covered hereunder.
