Aguilera, Director of Community Development G <br />SUBJECT: Adoption of Amendments to the Rent Stabilization <br />Ordinance No. 0-19A-89 <br />E <br />BACKGROUND: <br />This controversial Ordinance was given final approval by the voters of Colton in 1990. N <br />Since then, the Ordinance has been applied to several different requests for rent increases <br />by parks and rent reductions by home owners. Staff and the Commission have also <br />implemented the rent regulatory portions to all parks. Our legal staff, represented by Amy <br />York and Julie Biggs from Best Best & Krieger have also been involved in the implemen- p <br />tation of the Ordinance. <br />STATEMENT OF PROBLEM: <br />A <br />Through all these efforts to implement the Ordinance, it has become apparent that <br />there are several deficiencies in the Ordinance. <br />ANALYSIS: <br />These deficiencies can be grouped into several catagories, 1) legal issues 2) enforcement <br />by staff 3) enforcement by the Commission 4) ambiguities 5) contradictions and 6) inability <br />of the Ordinance to carry out its purpose of protecting mobile home owners from exorbitant <br />rent increases. <br />ALTERNATIVES: <br />P <br />There are a myriad of alternatives, most of which the Rent Stabilization Commission has <br />considered through the three month review process. All of the changes to the Ordinance <br />are issues that have been thoroughly discussed and reviewed by our legal staff. <br />0 <br />FINANCIAL IMPACT: <br />It is staff's opinion that the changes to the Ordinance will not adversly affect mobile home p <br />owners or mobile park owners and that the impact to the City is negligible since all R <br />operating costs are paid for by the registration fees. <br />ENVIRONMENTAL IMPACT: <br />The Design Review Committee recommends a negative declaration be issued for this <br />project. <br />Agenda Report CCRENT01 PAGE ; OF 2 <br />FILLS NO..a���.. �N...... <br />
