z0•d <br />wUL2:0T z66L-iz-zi <br />12/18/92 <br />PROJECT DZVELOPKENT AGREEMENT <br />FOR THE <br />COLTON/SAN BERNARDINO REGIONAL TERTIARY <br />TREATMENT AND WATER RECLAMATION SYSTEM <br />(Full -Sonia System) <br />THIS AGREEMENT is made and effective this day of <br />1993, by and among the CITY OF COLTON, a public agency <br />(kcawQN"), the CITY OF SAN BERNARDINO, a public agency, acting by <br />and through its Board of Water Commissioners ("SAN BERNARDINO"), and <br />the SANTA ANA WATERSHED PROJECT AUTHORITY, a joint powers public <br />agency ("SAWPA"). COLTON, SAN BERNARDINO and SAWPA are sometimes <br />individually referred to herein as the "PARTY" or, collectively, as <br />the "PARTIES". <br />RECITALS <br />A. Each of the PARTIES is empowered by law to own and operate <br />wastewater treatment and water reclamation plants. <br />B. Pursuant to that certain Coordinated operating Agreement <br />for the Colton/San Bernardino Regional Tertiary Treatment and Water <br />Reclamation System (Demonstration System) dated July 18, 1989, <br />COLTON and SAN BERNARDINO, with the assistance of SAWPA, recently <br />completed the successful implementation of a demonstration -scale <br />regional tertiary treatment and water reclamation system, as more <br />particularly described in Appendix "J" of that certain two -volume <br />study entitled "Facilities Plan for Regional Tertiary Treatment <br />System", dated December, 1988 supplemented by the Final <br />Demonstration Project Report, dated <br />60'39bd 96:6 86, 12 730 <br />
