BACKGROUND: D At their meeting of May 11, 1993, the Planning Commission considered, and approved, a proposal to amend Title 18 of the Colton Municipal Code (Zoning Ordinance) sections 18.06.060 "Uses Permitted in Each Zone", Section 18.04.218 "Food and Beverage Sales and 18.04 "Definitions". If approved by Council, the amendment will require a Conditional Q Use Permit for the sale of beer and wine in the Multiple -Family Residential (R-3), Business Park (BP), Neighborhood Commercial (C-1), General Commercial (C-2), Industrial Park (IP), Light Industrial (M-1), and Heavy Industrial (M-2) zones. DISCUSSION/ANALYSIS: R A letter dated February 24, 1993, from the City Manager's office, directed the Community Development Department to pursue an amendment to the Zoning Ordinance, concerning the sale of beer and wine. At the present time, the above use is permitted by right in the BP, C-2, IP, M-1, and M-2 zones, under the classification of "Food and Beverage Sales E The proposed amendment will do the following; 1. Revise Section 18.06.060 to include the use "Beer and Wine Sales" and to require a conditional use permit in the R-3, BP, C-1, C-2, IP, M-1 and M-2 zones. 2. Revise Section 18.04.218 "Food and Beverage Sales" to remove beer and wine sales from the definition. Q 3. Revise Section 18.04 "Definitions" to include the following new section: 18.04.079Beer and Wine S la_es_ R "Beer and wine sales means any premise engaged in the sale of beer and wine for on -premise or off -premise consumption, pursuant to state licensing, excluding liquor or bottled spirits.
