250 EICamino Real <br />Suite 102 <br />Tustin, CA <br />92680.3673 <br />(714) 544-0980 <br />FAX: (714) 5441979 <br />Ward THK <br />Claims Adjusters & Administrators <br />A Member Of <br />The Thomas Nowell Group <br />This <br />Agreement is entered into this <br />day of <br />, 1993, by and between the City <br />of Colton, hereafter <br />referred to as the Client, and Ward-THK, Inc., hereafter <br />referred to as <br />Ward. <br />SECTION I: <br />SERVICES PROVIDED BY WARD <br />Ward <br />agrees to perform the following services: <br />1. <br />Review all claims submitted by the <br />Client to Ward during <br />the term of the Agreement and handle <br />pursuant to the <br />Ward claims -handling standards. <br />2. <br />Coordinate all investigation of facts <br />and damages. <br />3. <br />Establish and maintain appropriate <br />reserves for each <br />claim. <br />4. <br />Maintain a separate file for each claim, <br />which shall be <br />available for review by the Client at <br />any reasonable time. <br />5. <br />Recommend settlement of claims <br />to the Client and <br />negotiate settlement pursuant to authority <br />extended by <br />the Client. <br />6. <br />Perform all reasonable and necessary <br />administrative and <br />clerical work in conjunction with each <br />claim, including the <br />preparation of checks or vouchers, <br />release agreements <br />and any other documents needed to <br />close a claim. <br />7. <br />Coordinate all litigation activity wth <br />selected outside <br />legal counsel <br />1 <br />So.
