CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of August 6, 1996 <br />TO: HONORABLE MAYOR & CITY COUNCIL <br />APPROVAL: MALIK FREEMAN, CITY MANAGER <br />FROM: BERNIE LUNSFORD, CHIEF OF POLICE` <br />SUBJECT: MINOR DAYTIME LOITERING ORDINANCE <br />DATE: JULY 24, 1996 <br />Presently the Police Department does not have a legal method to address minors who loiter or <br />wander about the community when they are to be attending school. <br />At present, the Police Department does not have an effective process to handle truants who <br />wander public streets and places during school hours. The Police Department's only alternative is <br />to simply return the minor to school and hope the problem does not reoccur, although police <br />officers are aware that there is a high probability that they will re -contact truant minors who have <br />or will commit some type of criminal act when they should have been in school. <br />The proposed ordinance allows the 'police to take enforcement action before someone in the <br />community becomes a victim of such a criminal act. This ordinance also allows the police <br />department to collect direct costs incurred by the department while processing and monitoring <br />minors prior to their release to a responsible adult. This portion of the ordinance is only triggered <br />with repeat offenders and thereby holds the parents accountable for knowing the whereabouts of <br />their children. <br />ALTERNATIVES: <br />The alternative to this ordinance is to maintain our present procedures and return minors to school. <br />FISCAL IMPACT: <br />There is no direct fiscal impact and some costs can be recovered under certain circumstances. <br />4 � <br />Bernard O.
