DELGADO <br />INTERIM CITY CLERK <br />SUBJECT: CITY CLERK. <br />DATE: AUGUST 1, 1996 <br />As I was getting ready to prepare agenda report and appropriate <br />documents, I reviewed Government Code Section 36512(b), which <br />states "If a vacancy occurs in an elective office ... the council <br />shall within 30 days ... either fill the vacancy by appointment or <br />call a special election..." <br />I believe the question of the need to call a special election is <br />rendered moot since the Council has already called for an election <br />for the office of City Clerk. <br />The item that remains to be addressed is the appointment of a City <br />Clerk to fill the vacancy that exists, for the remainder of the <br />term. Government Code Section 36502 holds that "A person is not <br />eligible to hold office as ... city clerk ... unless he or she is ... an <br />elector of the city and was a registered voter of the city at the <br />time nomination papers are issued to the candidate... 11 As Interim <br />City Clerk, I believe this matter should now be handled through <br />you. <br />Please know that even though I attend church, shop and enjoy the <br />restaurants in the City, alas, I am not a resident of the City of <br />Colton. <br />FA <br />ITEM NO. 42 <br />
