AGENDA REPORT <br />CITY OF COLTON <br />For City Council Meeting of <br />August 20, 1996 <br />August 8, 1996 <br />TO: MAYOR FULP, CITY COUNCIL AND CITY MANAGER <br />FROM: Julie Hayward Biggs, City Attofney <br />r <br />r <br />SUBJECT: Closed Session Procedures <br />As directed by the City Council, I have prepared the attached ordinance for your <br />consideration relating to closed session procedures. The ordinance reiterates the nature of closed <br />session meetings as permitted under the Ralph M. Brown Act (the 'Brown Act") and the duty <br />of those present in closed session to hold all matters discussed in strictest confidence. The <br />ordinance also provides an enforcement mechanism that refers violations of the confidentiality <br />requirements to an ad hoc committee of the City Council for action. The City Council is <br />empowered to censure individuals for violation of the confidentiality rules or to refer the matter <br />to the District Attorney for prosecution as a misdemeanor. Penalties for violation of this <br />ordinance upon conviction of a misdemeanor include a fine of not more than $1,000 or <br />imprisonment for a term not to exceed six months. <br />Concurrence: <br />Malik Dantala Freeman, Interim City Manager <br />= NO. 41 <br />
