1 <br />notice, public hearing, and appeal as for a Certificate of Appropriateness <br />2 <br />shall apply. <br />PP Y• <br />3 <br />A Certificate of a Hardship shall be granted only if the owner(s) of the <br />4 <br />designated property in question can produce evidence to show that: <br />5 <br />(1) reasonable use or return on the property is not possible under the <br />6 <br />conditions of the Certificate of Appropriateness; and <br />7 <br />(2) alternative plans which would be in keeping with the interest of <br />this Ordinance are not feasible. <br />8 <br />The Commission may delay the decision on the application for a <br />9 <br />period not to exceed ninety (90) days to investigate plans to allow for"a <br />10 <br />reasonable use of or return from the property or other measures to preserve <br />11 <br />the property, including selling the property to an individual or group that <br />12 <br />would preserve it. <br />13 <br />The Commission shall review the evidence and make a written finding, <br />14 <br />stating the facts and reasons behind the decision. It shall notify the <br />C <br />applicant by mail of the acceptance or denial or the Certificate of Hardship. <br />15 <br />15.40.100 Historical Building Code. <br />16 <br />Alternative building regulations may be used for the rehabilitation, <br />17 <br />preservation, restoration, or relocation of structures designated as Historic <br />18 <br />Resource Buildings. The State Historical Building Code ( part 8 of Title 24 of <br />19 <br />the California Administrative Code) shall be used for any historic resource <br />20 <br />through the City s building permit procedure. <br />15.40.110 Conservation Easements. <br />21 <br />Conservation easements on the facades of buildings designated as <br />22 <br />Historic Resource may be acquired by the City or non-profit group through <br />23 <br />purchase, donation, or condemnation pursuant to California Civil Code 815. <br />24 <br />15.40.120 Maintenance and repair. <br />25 <br />A. This Ordinance shall not be construed to prevent the ordinary <br />26 <br />maintenance or repair of exterior architectural features, walls, landscapes, <br />27 <br />etc. in or on any designated property that does not involve a change in <br />28 <br />design, materials, or external appearance thereof, nor does this Ordinance <br />19 <br />
