CLAIMS ADMINISTRATION SERVICE AGREEMENT <br />This Agreement is entered into between the City of Colton, hereafter referred to as the <br />City, and Ward-THG, hereafter referred to as Ward. <br />SECTION I: SERVICES PROVIDED BY WARD: <br />Ward agrees to perform the following services: <br />1. Handle all claims submitted by the City to Ward during the term of the Agreement <br />pursuant to the Ward claims handling standards. <br />2. Coordinate all investigation of facts and damages. <br />3. Establish and maintain appropriate reserves for each claim. <br />4. Maintain a separate file for each claim, which shall be available for review by the City at <br />any reasonable time. <br />5. Recommend settlement of claims to the City and negotiate settlement pursuant to <br />authority extended by the City. <br />6. Perform all reasonable and necessary administrative and clerical work in conjunction with <br />each claim, including the preparation of checks or vouchers, release agreements and any <br />other documents needed to close a claim. <br />7. Coordinate all litigation activity with selected outside legal counsel. <br />8. Notify the excess carrier on all excess claims, pursuant to ICRMA reporting guidelines. <br />9. Attend court settlement conferences, including voluntary settlement conferences. <br />10. Attend Quarterly Claim Reviews. <br />11. Manage the City's Loss Fund Account and provide monthly statements of account. <br />12. Provide Management Information Reports according to the City's schedule. <br />
