I ORDINANCE NO. 0IB-96 <br />2 <br />AN URGENCY ORDINANCE OF THE CITY OF COLTON <br />3 EXTENDING THE MORATORIUM ON ADULT USES AND <br />AN EXCEPTION PROCESS ALLOWING APPLICATIONS <br />4 FOR EXCEPTIONS AS TO ADULT USES WITHIN THE <br />5 CITY OF COLTON (Government Code Section 65858) <br />6 <br />7 The City Council of the City of Colton ("the City") finds, determines and <br />declares that: <br />8 <br />9 A. Numerous provisions of the City's Zoning Code that regulate adult businesses <br />10 including, but not limited to, portions of Chapter 18.04.018, Section 18.06.060, 18.48.010 <br />11 and Chapter 18.28 need review, study and possible revision in order to respond to recent <br />12 developments within the regulation of adult uses and case law interpretation. Because of <br />13 their age, such provisions fail to fully take into account the secondary effects that are <br />14 <br />15 associated with adult uses and fail to address the needs of the City and its residents today ano <br />16 in the future. <br />1711 B. On May 7, 1996 the City Council adopted by a unanimous vote Ordinance <br />18 1 No. 0-12-96 entitled "An Urgency Ordinance Of The City Council Of The City Of Colton, <br />19 California, Imposing A Moratorium On Adult Uses And An Exception Process Allowing <br />20 Applications For Exceptions As To Adult Uses Within The City Of Colton (Government <br />21 <br />Code Section 65858). <br />23 C. By force of law and its own terms, Ordinance No. 0-12-96 expires and is no <br />24 further force and effect after forty-five (45) days from its effective date, unless further <br />25 extended on or before the forty-fifth (45th) day. <br />26 D. The City Council received a staff report dated June 4, 1996, incorporated by <br />27 this reference, which states that since the adoption of Ordinance No. 0-12-96, the City has <br />28 <br />
