AGENDA REPORT <br />CITY OF COLTON <br />For City Council Meeting of <br />October 1, 1996 <br />September 24, 1996 <br />TO: MAYOR FULP, CITY COUNCIL AND CITY MANAGER <br />FROM: Julie Hayward Biggs, City Atto> <br />SUBJECT: Resolution Regarding Contract Approval <br />As requested by the City Council, the attached Resolution has been prepared estab <br />lishing a policy that requires that the City Manager submit all contracts to the City Council in <br />final form prior to execution by any authorized individual. While there was some discussion of <br />establishing this policy by adoption of an ordinance that would be subject to prosecution as a <br />misdemeanor, that in fact does not appear to be a realistic or appropriate way to address this <br />issue. Rather, establishing an express policy by Resolution requiring the City Manager to <br />properly submit contracts in final form unless otherwise directed by a two-thirds majority of the <br />Council puts the burden where it belongs and provides the appropriate sanction, which is the <br />possibility of disciplinary action. Ultimately, the responsibility of the Council and the City <br />Manager is to assure that contract matters are handled appropriately. The ultimate sanction that <br />the City Council may impose on a City Manager is termination. <br />The Council should consider the proposed Resolution and direct this office as to <br />any changes it deems necessary. <br />Concurrence: <br />Malik Dantala Freeman, Interim City Manager <br />ITEM 29 <br />
