in the City, and its owner, a Stormwater Management User Fee. This fee is <br />necessary to pay for (1) the operation, administration, maintenance, improvement, <br />environmental restoration, and replacement of the existing and future storm <br />drainage system, (2) improving the quality of stormwater, (3) complying with <br />local, state, and federal stormwater regulations and (4) to pay for, or secure the <br />payment of, any indebtedness incurred for these purposes. All of the proceeds <br />of these fees are in payment for use in the city's storm drain system by developed <br />and undeveloped parcels and their owners. This fee shall not exceed the <br />reasonable cost of providing the services, facilities or regulatory activity for <br />which the fee is charged." <br />As can be seen, use of the NPDES assessment fees for construction of stormwater drainage <br />facilities that improve the current drainage system, which of course includes the San Timoteo <br />Creek watercourse, is appropriate under the City's ordinance. <br />You should be aware that the provisions of Proposition 218 may come into play <br />in regard to the City's NPDES assessment. That proposition requires voter approval of "general <br />assessments" such as the NPDES assessment. If passed, the City's NPDES assessment could <br />be invalidated. If that occurs, no funds from this source will be available to the City unless the <br />voters approve a new general assessment. <br />Proposition 218 will not apply, however, to the special benefit assessment that has <br />been established by the County of San Bernardino for this project. <br />Concurrence: <br />Malik Dantala Freeman, Interim City Manager <br />
