211 RESOLUTION NO. R-99-96 3 RESOLUTION AUTHORIZING THE MAYOR OF THE CITY COUNCIL TO ISSUE SUBPOENAS PURSUANT TO 4 GOVERNMENT CODE SECTION 37104 ET. SEQ. FOR THE PURPOSE OF CONDUCTING AN AUDIT OF 5 CITY'S GAS, ELECTRIC, WATER, TELEPHONE, WASTE MANAGEMENT, AND CATV UTILITY USERS TAX 6 AND FRANCHISE FEES 711 BE IT RESOLVED by the City Council of the City of Colton, California that: 811 WHEREAS, the City derives substantial revenues from its utility users taxes and franchise 911 fees; WHEREAS, it is prudent and appropriate that the City perform a periodic audit of those 111 I persons or entities responsible for the collection and/or,payment of utility users taxes and franchise 1211 fees to the City; 13 WHEREAS, in order to conduct a thorough and efficient audit, the City requires reasonable 14 access to certain information, records, and data of those persons or entities responsible for the 15 collection and/or payment of utility users taxes and franchise fees to the City; 16 WHEREAS, with respect to the City's auditing of gas, electric, water, telephone, waste 17 management and CATV utility users taxes and franchise fees, the City has retained the services of 18 Municipal Resource Consultants and Donald H. Maynor (through MRC), hereinafter "Consultants"; 19 NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Colton hereby: 20 I. Institutes an audit proceeding of the City's gas, electric, water, telephone, waste 21 management and CATV utility users taxes and franchise fees, wherein the City Staff and Consultants shall periodically report to the City Council the findings of such audit 2311 activities. 2411 2. Authorizes the Mayor of the City Council to issue subpoenas pursuant to Government Code Section 37104 et seq., requiring the subpoenaed party to provide certain 2611 information to the City and/or its authorized representatives for purposes of conducting 2711 an audit of the City's gas, electric, water, telephone, waste management and CATV M
