AGENDA REPORT <br />CITY OF COLTON <br />For City Council Meeting of <br />September 17, 1996 <br />September 10, 1996 <br />TO: MAYOR FULP, CITY COUNCIL AND CITY MANAGER <br />FROM: Julie Hayward Biggs, City Attom#t <br />SUBJECT: Closed Session Disclosure Ordinance <br />As you requested at the City Council meeting held on August 20, 1996, I have <br />reviewed and revised the proposed ordinance imposing penalties for disclosure of confidential <br />information discussed in closed session. As you may recall, the Council expressed serious <br />concern about the establishment of an ad hoc committee to review alleged violations of the <br />ordinance. To address that issue, the ordinance has been re -written to require that in the event <br />a violation is reported, the City Council must initially refer the matter to the City Attorney and <br />the Chief of Police for formal investigation. The City Attorney and Chief of Police will then <br />report their findings to the City Council in closed session as a matter of potential litigation, and <br />the City Council will take such action as it deems appropriate, including censure, sanction or <br />referral of the matter to the District Attorney for prosecution. The direction of the City Council <br />will then be reported publicly. <br />The City Council should consider this ordinance and its structure to determine if <br />it accomplishes the goals of the Council with regard to this kind of matter. If the ordinance is <br />acceptable to the City Council, the Council may waive First Reading and adopt the ordinance. <br />If it is not acceptable to the City Council, then the Council should give this office further <br />direction. <br />Concurrence: <br />Malik Dantala Freeman, Interim City Manager <br />ITEM NO. 36 <br />
