AGENDA REPORT CITY OF COLTON For City Council Meeting of September 17, 1996 September 10, 1996 TO: MAYOR FULP, CITY COUNCIL AND CITY MANAGER FROM: Julie Hayward Biggs, City Att JArov' SUBJECT: Resolution Regarding Contractal As requested by the City Council, the attached Resolution has been prepared estab- lishing a policy that requires that the City Manager submit all contracts to the City Council in final form prior to execution by any authorized individual. While there was some discussion of establishing this policy by adoption of an ordinance that would be subject to prosecution as a misdemeanor, that in fact does not appear to be a realistic or appropriate way to address this issue. Rather, establishing an express policy by Resolution requiring the City Manager to properly submit contracts in final form unless otherwise directed by a two-thirds majority of the Council puts the burden where it belongs and provides the appropriate sanction, which is the possibility of disciplinary action. Ultimately, the responsibility of the Council and the City Manager is to assure that contract matters are handled appropriately. The ultimate sanction that the City Council may impose on a City Manager is termination. The Council should consider the proposed Resolution and direct this office as to any changes it deems necessary. Concurrence: Malik Dantala Freeman, Interim City Manager ITEM NO. 38
