CLARKE, UTILITY DIRECTOR"" <br />SUBJECT: ACCEPTANCE OF THE PLANNING COMMISSION'S RECOMMENDATION <br />FOR APPROVAL OF THE MITIGATED NEGATIVE DECLARATION FOR <br />THE WASTEWATER TREATMENT PLANT'S EXPANSION & RENOVATION <br />DATE: FEBRUARY 25, 1997 <br />BACKGROUND: <br />On April 7, 1995,,the Regional Water Quality Control Board (RWQCB) adopted Cease and <br />Desist Order No. 95-36 (CDO 95-36) requiring the City to stop issuing connections to the <br />sewer system, to prepare a report of deficiencies at the Wastewater Treatment Plant (Title <br />22 Report) and to develop plans and schedules for making repairs and improvements <br />identified in the Title 22 Report. On August 15, 1995, the City completed the Title 22 Report <br />and submitted it to the RWQCB. On August 18, 1995, the City Council adopted Plans and <br />Schedules for Compliance with CDO No. 95-36. The State Board of Water Resources <br />requirements for submission of a loan application include an Environmental Impact Report <br />(EIR) or a Negative Declaration. The City must advertise the public hearing 30 days prior to <br />the actual hearing, and hold one public hearings for the project. <br />DISCUSSION/ANALYSIS: <br />The notice was published on January 16, 1997, and the Planning Commission began the <br />public hearing process on January 28, 1997 and continued until February 25, 1997 and <br />again to March 11, 1997 (both canceled due to lack of a quorum). This allowed the public <br />ample time to comment on the project. At the March 25, 1997 Planning Commission <br />meeting, the public hearing was closed, and the mitigated negative declaration for the <br />project was approved. <br />ALTERNATIVES: <br />The only alternative lies in the method for funding. In order to complete the project in the <br />Regional Water Quality Control's required time frame, outside funding is needed. The debt <br />service for this action has been included in the Wastewater Financial Plan, including the <br />rates. <br />FINANCIAL IMPACT: <br />The City of Colton is being required to expand its secondary capacity, as well as make <br />repairs to its existing secondary facilities. The cost of the design, expansion and repairsare <br />estimated at $16,367,000.00 . The City of Colton may either: 1) Obtain a State Revolving <br />Fund loan at a low interest rate; or 2) Obtain bonding.
