Mayor and Council Members <br />Council Meeting of April 1, 1997 <br />Page 2 <br />Agenda Item: Approval of Water Conservation Plan and New Wastewater Rate <br />Schedule for Implementation of a Commercial/industrial Rate Based <br />on Strength of Discharge, as Required by the State Water Resources <br />Control Board for State Revolving Fund Loan Approval. <br />Also, attached is a new Wastewater Rate Schedule for Implementation of a <br />Commercial/Industrial Rate Based on Strength of Discharge, which the. City previously <br />committed to implement. A Wastewater Rate based on strength of discharge will effect' <br />only those commercial/industrial customers that discharge effluent which is not limited:- <br />to restroom discharges. The new Wastewater Rate for Strength Discharge must be in <br />effect prior to the last payment being made from the SRF loan. On December 5, 1995, <br />Council adopted a Resolution Adopting and Committing to Plans and Schedules for <br />Compliance with Cease and Desist Order #95-36. The Plans and Schedules set June <br />30, 1998 as the date for construction to begin on the Secondary Wastewater Treatment <br />Plant Expansion and Renovation Project. The construction is expected to be <br />completed by June 30, 2000. Prior to completion of the project, the new Wastewater <br />Rates based on Strength of Discharge for Commercial/industrial Users must be in <br />effect. Staff anticipates implementation of these new rates in May, 2000. <br />FINANCIAL IMPACT: <br />The Council has committed to a course of action which will ultimately require the <br />expenditure of between 6 and 40 million dollars. The Wastewater Rates are scheduled <br />for review in February, 1998; with any increases to be effective on July 1, 1998. At that <br />time a rate based on strength of discharge will be prepared for review by the Utilities <br />VCssion and aeproval by Council. <br />Thomas K. Clarke, Utility Director <br />ALTERNATIVES: <br />In order to comply with Cease and Desist Order #95-36, which also requires the City to <br />obtain sufficient funding for the expansion and renovation work, the Council must adopt <br />the Wastewater Rate Schedule for Implementation of a Commercial/Industrial Rate <br />Based on Strength of Discharge. Failure to do so will invoke the penalty provisions of <br />the Order, which include daily fines and possible legal action. <br />RECOMMENDATION: <br />Staff recommends that Council adopt the attached Water Conservation Plan and the <br />Wastewater Rate Schedule for Implementation of a Commercial/industrial Rate Based <br />on Strength of Discharge. <br />Attachments: Water Conservation Plan <br />Wastewater Rate Schedule <br />Report Prepared By: Lorraine June <br />
