R-96-97 <br />DUPLICATE <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON CONFIRMING THE CITY'S GOOD FAITH <br />INTENT TO CONTINUE TO WORK WITH TAORMINA <br />INDUSTRIES, INC. IN A PROFESSIONAL AND POSITIVE <br />MANNER UNDER THE FRANCHISE AGREEMENT <br />ENTERED INTO IN 1996 <br />WHEREAS, the City Council on May 16, 1996 approved the "Agreement between the <br />City of Colton and Taormina Industries, Inc. for Municipal Solid Waste, Recyclables and Green <br />Waste Collection and Transportation to Disposal, Composting and Processing Facilities," (the <br />"Agreement") between the City of Colton ("City") and Taormina Industries, Inc. ("Taormina"); <br />FMO <br />WHEREAS, the Agreement was entered into after an exhaustive and competitive <br />procurement process in which Taormina was selected as the most qualified provider after <br />extensive narrowing of competitors through independent review of the various proposals that <br />were submitted in response to the City's request for proposal process; and <br />WHEREAS, although certain issues have arisen in recent months regarding the <br />relationship between Taormina and the City, the parties have generally operated successfully and <br />in accord with the provisions of the Agreement since Taormina commenced operations within <br />the City on. July 1, 1996 and the City is pleased with the performance of Taormina under the <br />terms of the Agreement; and <br />WHEREAS, Taormina and the City Council have publicly confirmed their intention to <br />continue to operate in accord with all of the terms of the Agreement, subject to such necessary <br />modifications as may be mutually agreed upon through the negotiation process; and <br />Item No. 23 <br />
