CITY OF COLTON AGENDA REPORT DUPLICATE FOR COUNCIL MEETING OF FEBRUARY 4, 1997 TO: Honorable Mayor and City Council APPROVAL: M ik Fr eman, City na , FROM: D i Zamora Community Devel m Director SUBJECT: Amendment to Colton Municipal Code Repealing and Amending Certain Provisions Pertaining to Business Licenses, File Index Number DO -03-97 I DATE: January 29, 1997 BACKGROUND: The City of Colton Community Development Department was requested to initiate an amendment to the business license regulations set forth in the City's Municipal Code at Chapter 5.02. On January 28, 1997, the Planning Commission considered File Index Number DO -03-97, a proposed ordinance to repeal in its entirety subdivision F of section 5.02.040, which permits the City's Collector, as that term is defined in section 5.02.020, to require additional unspecified information on the business license application and to resdesignate subdivision G of section 5.02.040 as subdivision F. After consideration of all the evidence presented, including staff comments and the proposed ordinance, the Commission adopted the attached Resolution, Number R-02-97, a recommendation to the City Council to adopt the proposed ordinance repealing and amending certain sections of the Colton Municipal Code pertaining to business licenses. - DISCUSSION/ANALYSIS: Subdivision F of section 5.02.040 currently provides that an applicant for a business license may be required, in addition to the information specifically enumerated, to provide "[f]urther information which the collector may reasonably require to enable him to issue the type of. license applied for." Staff feels that this provision should be deleted to conform to recent case law decisions governing approvals of such licenses. Attached to this report is a copy of the materials provided to the Planning Commission at their public hearing of January 28, 1997, at which the Commission made its recommendation to the City Council. The staff report of the Planning Commission constitutes the analysis for this staff report. Item No. 24
