R-13-97 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />SUPPORTING A CITIZENS INITIATIVE TO REPEAL SAN <br />BERNARDINO COUNTY ASSESSMENT DISTRICT 95-1; RE -DESIGN OF <br />CERTAIN FLOOD CONTROL IMPROVEMENTS FOR THE SAN <br />TIMOTEO CANYON FLOOD CONTROL PROJECT TO BE MORE <br />ENVIRONMENTALLY SENSITIVE; AND, REQUEST TO COUNTY OF <br />SAN BERNARDINO THAT SPECIAL ASSESSMENTS IMPOSED ON <br />PROPERTY LOCATED WITHIN THE CITY OF COLTON LYING <br />WITHIN ASSESSMENT DISTRICT 95-1 BE RECALCULATED TO <br />REFLECT ACTUAL BENEFIT TO SUCH PROPERTIES <br />WHEREAS, by Resolution No. 95-78, adopted on April 18, 1995, the County of San <br />Bernardino gave notice of its intention to order acquisitions and improvements with respect to <br />Assessment District No. 95-1 for the purpose of making flood control improvements to complete <br />the third reach of the San Timoteo Creek flood control project which is a part of the Santa Ana <br />Mainstem project being designed and constructed within San Bernardino County by the United <br />States Corps of Engineers. Resolution 95-78 was superseded by action of the San Bernardino <br />Board of Supervisors by Resolution No. 95-78A which was adopted on May 7, 1996; and <br />WHEREAS, by Resolution No. R-25-96, the City Council of the City of Colton <br />expressed its support for the establishment of Assessment District 95-1 and determined that <br />certain property within the City of Colton would benefit from the San Timoteo Creek flood <br />control improvements proposed to be constructed within Assessment District 95-1; and <br />WHEREAS, these resolutions collectively led to the establishment of Assessment District <br />95-1 by adoption of Resolution Nos. 96-169, 96-170 and 96-171 on July 9, 1996 which includes <br />land within the City of Colton; and <br />
