City Council Meeting of February 18, 1997
Adult Use Ordinance
Page 2
The existing adult use regulations, as set forth in Chapter 18.48, restrict adult uses to the M-
2 zoning district. Adult uses are prohibited from locating within 1,000 feet of any residential
zone, school; public park, church, institution or other similar use. Adult uses are required to
obtain a Conditional Use Permit to operate.
The proposed ordinance would maintain the M-2 zoning designation and 1,000 foot distance
requirement for adult uses. The ordinance would replace the Conditional Use Permit
requirement with an adult use development permit and eliminates "institution or other similar
use" from the sensitive use category. In addition, definitions are also added.
Attached to this report is a copy of the materials provided to the Planning Commission at
their public hearing of January 28, 1997, at which the Commission made its recommendation
to the City Council. The staff report of the Planning Commission constitutes the analysis for
this staff report.
FINANCIAL IMPACT:
No impact to the City's General Fund.
bART6 R. ZAM --
Community Dev ment Director
ENVIRONMENTAL IMPACT:
None. Based on the Initial Study, the Planning Commission has determined that there will
be no significant impact to the environment, and recommends that a Negative Declaration be
filed.
RECOMMENDATION:
The Planning Commission and the staff recommend that the City Council hold the public
hearing on the Planning Commission recommended proposed adult use ordinance and
environmental review, approve the Negative Declaration based on the Initial Study, and
approve the proposed adult use ordinance.
DRZ /kd
Attachments: Resolution
Planning Commission Staff Report w/attachments (4A
Photographs s
