AGENDA REPORT <br />PAGE TWO <br />Staff is bringing this matter before the Council as expeditiously as possible <br />so as to assist Mr. Wyatt in obtaining title suitable for conveyance to his buyer. <br />Additionally, an amended version of the 1990 Resolution memorializing the vacation of <br />the subject alley is included in this item because the legal description set forth in the 1990 <br />Resolution was inaccurate. Actual recordation of the alley's vacation did not occur in 1990, but <br />rather in 1994 when the County Recorder was apprised of the correct legal description. <br />Approval of this amended Resolution will merely correct the City's records, and will have no <br />impact on fee title ownership of the alley. <br />FINANCIAL IMPACT: <br />Depending upon what the Council determines to be fair compensation for this seventeen <br />(17) by eighty-one (8 1) foot strip of property, the City may receive monetary or other payment <br />of an undetermined amount. <br />ENVIRONMENTAL IMPACT: <br />None. <br />RECOMMENDATION: <br />Staff recommends that the Council authorize the execution and recordation of the <br />Quitclaim Deed and adopt the Resolution amending the legal description of the alley. <br />Concurrence: <br />Malik Dantala Freeman, Interim City Manager <br />
