WW97-3 THIS CONTRACT SERVICES AGREEMENT (herein "Agreement") is made and entered into this 6t�' day of August 1997 by and between the CITY OF COLTON (herein "City"), a municipal corporation, and Pima Gro Systems, Inc.,(herein "Contractor). The parties hereto agree as follows: SECTION l: SERVICES OF THE CONTRACTOR: 1. � Scope of Agreement This Agreement concerns the removal, hauling and disposal of anaerobic digested dewatered municipal sludge form the City of Colton's Wastewater Treatment Plant located at 1201 South Rancho Avenue, Colton, CA 92324-2897 (the r, "Szte"). In compliance with the terms and conditions of this Agreement, the Contractor is to provide a11 services, including a11 supervision; labor, equipment and materials, and a11 other resources necessary for the proper performance of its obligation under this contract. 1.2 Scope of Services. In accordance with Section 1:1, and the following terms and conditions of this Agreement, the Contractor is to remove, haul and dispose of, or treat, recycle andlor destroy all anaerobic digested sludge ("Sludge") presently located at the Site, and all future Sludge under the length ofthis Agreement. The Sludge is to be removed over a period of no more than 10 days from the initial date of being notified to remove the Sludge. The Contractor represents and warrants that all services performed in connection with this Agreement will be performed in a competent, professional and satisfactory manner, and will be performed in accordance with the standards prevalent in the industry. 13 Compliance with Law. The Contractor represents, and warrants, that all seruices rendered hereunder shall be provided in accordance with all ordinances, resolutions, statutes, rules and regulations of the United States of America, the State of California, the County of San Bernardino, and all other regional and local governmental agencies within the jurisdiction. 1.4 Term of the Contract. The Contract will be for FiscaT Year 1997-98 (July to June), with an option to renew for Fiscal Year 1997-98 (July to June), with an option to renew for Fiscal Year 1998-99.
