SBPEA, GENERAL UNIT DRAFT <br />ARTICLE I, EMPLOYER-EMPLOYEE RELATIONS <br />Section 1, Recognition <br />replace first paragraph with: The City hereby recognizes the San Bernardino Public Employees <br />Association (SBPEA) as the representatives of employees in the General Unit, which <br />encompasses all full-time positions in the City of Colton in the following classifications: <br />(list of all current classifications) <br />(additionally, all reference(s) in MOU to regular, part-time positions/employees shall be deleted) <br />Section 4, Grievance Procedure <br />III. E. If the grievant is not satisfied with the decision of the City Manager, the grievant may, <br />within ten days from the date of receiving the decision of the City Manager submit a written <br />request to the City Manager for the grievance to be heard by a hearing officer. The hearing <br />officer will be mutually selected by the City and grievant. <br />(delete second paragraph in current section) <br />If the parties are unable to mutually select a hearing officer, the State Mediation and Conciliation <br />Service shall be requested to submit a list of seven persons qualified to act as arbitrators. Within <br />five days following receipt of the list of arbitrators, the parties shall select a hearing officer. The <br />parties shall alternately strike one name from the list until one name remains. The right to strike <br />the first name is determined by lot. <br />(delete fourth paragraph in current section) <br />Each party shall bear equally the cost of the fees and expenses of the arbitrator and court reporter, <br />if any. Each party shall bear its own witness and attorney fees. <br />(delete sixth paragraph in current section) <br />The hearing officer shall render a decision in writing within 30 days of the closing of the record, <br />except that if the parties submit closing briefs, the hearing officer's decision shall be rendered <br />within 45 days after receipt of the briefs. <br />The findings and decision of the hearing officer are final and binding and not subject to any <br />administrative or judicial review except pursuant to the Code of Civil Procedure Section 1286.2 <br />or 1094.6. <br />(delete section III. F. in its entirety) <br />ARTICLE II, COMPENSATION <br />Section 1A, Classification and Compensation Study <br />The City and Association agree to the implementation of the Classification Compensation Study <br />to be completed in June 1997. The City and Association agree to set Colton employees' wages <br />at the average of the cities surveyed. Negotiations shall reopen upon receipt of the Salary Study <br />(approximately June 1997) to discuss impact and implementation schedule of the Compensation <br />Study. <br />SBPEA, General Unit final language <br />
