1 <br />2 INTERIM URGENCY ORDINANCE NO. 0-15-97 <br />3 AN INTERIM URGENCY ORDINANCE OF THE CITY OF <br />4 COLTON ESTABLISHING A MORATORIUM ON <br />PROCESSING OF APPLICATIONS FOR THE <br />5 CONSTRUCTION OF MONOPOLES NOT ALREADY <br />6 APPROVED WITHIN THE CITY <br />7 WHEREAS, the City Council has recently received information from the public <br />8 indicating serious concern about the creation of visual blight within the City by the proliferation <br />9 of "monopoles," which are pole devices usually standing more than 35 feet in height constructed <br />10 to allow cellular telephone transmission and other airwave transmission and which are currently <br />11 <br />12 not regulated in the City; and <br />13 WHEREAS, the Planning Commission has in the past approved the granting of <br />14 conditional use permits and variances allowing monopoles despite the fact that such monopoles <br />15 are not specifically addressed within the City's zoning ordinance; and <br />16 WHEREAS, residents of the community and of surrounding cities have voiced strong <br />17 opposition to the further proliferation of such monopoles within the City of Colton and certain <br />18 <br />19 uniform regulations for the approval of such devices have been developed in other communities <br />20 which the City would like to review and consider implementing in Colton; and <br />21 WHEREAS, it is imperative that the City review its zoning ordinance to assure that <br />22 further construction of monopoles within the City furthers the best interests of the community <br />23 and furthers the health, safety and welfare interests of the community; and <br />24 WHEREAS, Government Code Section 65858 authorizes the City Council to adopt as <br />25 <br />26 an urgency measure an interim ordinance prohibiting the processing of any applications for <br />27 conditional use permits or variances to construct monopoles while the City considers <br />28 <br />
