(28) Tender of Legal Defense , <br />Approve cost of litigation for Councilmember David Sandoval and City Attorney Julie <br />H. Biggs, who are defendants in the lawsuit known as Stetivard v. Scrr&oval Bios et <br />cr1. <br />STAFF REPORTS: <br />UTILITIES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Utilities Director Clarke requested approval of a Resolution to modify fees and charges, the <br />result of a program undertaken to modify metering to the City's largest industrial customers <br />and to offer said customers a program whereby they can buy a report from the Utility, which <br />will contain 15 -minute load interval data and other information about their service which can <br />be used in their planning and conservation programs and any load management programs. <br />Director Clarke reported that meters have been purchased and installed, as well as installed <br />telephone Eines for remote access, and also purchased software to interrogate the meters and <br />produce the reports. The Fee schedule has been modified to assess the customers a S50 <br />charge per month, or 5420 per year, for the Utility to provide the information to them. <br />Director Clarke concluded that this matter had been presented to the Utilities Commission. <br />Motion/second by CM Sanders/Cook to accept and approve staffs recommendation carried <br />upon unanim6-6'sVote. <br />RESOLUTION NO.
