RECEIVED MAR 171998 CITY OF COLTON PERSONNEL Our evaluation reflects this would be a case of highly questionable or no liability on the part of the City of Colton. Therefore, we recommend that this claim be rejected to commence the. statute of limitations. Our recommendation is based on the memorandum from Harry Rheubotton dated July 23, 1997 which states, during the replacement of Mt. Vernon's main line the contractor did not observe a lateral for this property and the house was not occupied at the time of the replacement, so hook up was not made. The contractor only hooked up laterals that he observed during the replacement of the main line on Mt. Vernon. All properties had 4" clay pipe and the plumber ran into a 6" cement pipe on the property, but it did not go to the main line in the city. The memorandum from Martin G. Ragels dated October 15, 1997 has been reviewed and it states that according to the permit records, the dwelling at 388 N. Mt. Vernon Avenue is located on the same parcel of land as 384 N. Mt. Vernon Avenue. The City records indicate that there has never been a permit issued for the sewer lateral at*88 N. Mt. Vernon Avenue, The permit records reveal one single family dwelling and a storage unit. The permit file does not indicate two dwellings. This may explain why the water department only shows one lateral from that property. Should there be any questions regarding this matter, please contact me at your earliest convenience.
