Discussion: <br />Staff believes that since the licensed cosmetology establishments are already heavily <br />regulated by the state, owners/operators of such establishments who wish to provide incidental <br />massage services should not be required to obtain a massage permit and the business license for <br />operation of a massage parlor pursuant to Chapter 5.24. Staff believes that the proposed <br />revisions to Chapter 5.24, as indicated in the legislative version of the ordinance attached hereto, <br />will provide the City with adequate ability to protect the employees and patrons of the <br />cosmetology establishments performing incidental massage services. The massage services must <br />be truly incidental to the operation of the cosmetology establishment, as indicated in Section <br />5.24.190. As you can see, the establishments will only be authorized to employ one (1) massage <br />technician for every three (3) cosmetologists on staff. <br />In. addition, since the owners/operators of massage parlors are the more appropriate <br />persons to hold responsible for civil and criminal complaints by means of the $1,250 first year <br />business license fee and the $500 continuing fee, staff would like to suggest that the business <br />license fees for all massage technicians be lowered to $100. <br />Finally, staff believes that additional clarifying revisions to Chapter 5.24 are necessary, <br />including revised and additional definitions, as indicated in the legislative draft attached hereto <br />Environmental impact: <br />This is not a project pursuant to the California Environmental Quality Act. <br />Fiscal impact: <br />Not significant. Unknown reduction in business license fees by reduction of massage <br />technician license fees to $100. <br />Recommendation: <br />Approve the attached proposed ordinance amending Chapter 5.24 of the Colton Municipal <br />Code regarding massage parlors and massage technicians, and authorize the Mayor to execute it <br />as written. <br />RVPUB\DRD\39967 <br />
