Legal Services — Page Three Cost of Service and Adeauate Revieweri In an effort to control legal costs, I have confirmed with Best Best & Krieger that they would agree to a $550,000 cap on their legal costs for the 1998-1999 fiscal year. In order to insure that this cap is achieved, the City must enter into an agreement with Best Best & Krieger that provides for the cap under a one year term, which may be automatically renewed based on the City Manager's recommendation to the City Council. I believe that this cap demonstrates a commitment from our legal service provider and establishes a positive working relationship with the City. In terms of adequate review period, I am confident based on the current six months of services provided by Best Best & Krieger to recommend continuing with their services, with the negotiated cap on legal fees for 1998-1999 fiscal year. Recommendation Based on the current level of services received, the status of pending projects and the existing working relationships between Best Best & Krieger and the City's staff, I recommend that we do not solicit RFP's at this time. Not only would sending out an RFP at this time be disruptive, I believe that it would damage the City's position on some of our significant issues. The quality of services received and willingness to put a cap on legal services costs support the recommendation for: COUNCIL APPROVE $550,000 CAP FOR BEST BEST & KRIEGER LEGAL SERVICES FOR FY 1998/99 AND APPOINT AS PERMANENT CITY ATTORNEY FOR THIS PERIOD.
