Legal Services — Page Three <br />Cost of Service and Adeauate Revieweri <br />In an effort to control legal costs, I have confirmed with Best Best & Krieger that they would agree <br />to a $550,000 cap on their legal costs for the 1998-1999 fiscal year. In order to insure that this cap <br />is achieved, the City must enter into an agreement with Best Best & Krieger that provides for the cap <br />under a one year term, which may be automatically renewed based on the City Manager's <br />recommendation to the City Council. I believe that this cap demonstrates a commitment from our <br />legal service provider and establishes a positive working relationship with the City. <br />In terms of adequate review period, I am confident based on the current six months of services <br />provided by Best Best & Krieger to recommend continuing with their services, with the negotiated <br />cap on legal fees for 1998-1999 fiscal year. <br />Recommendation <br />Based on the current level of services received, the status of pending projects and the existing <br />working relationships between Best Best & Krieger and the City's staff, I recommend that we do not <br />solicit RFP's at this time. Not only would sending out an RFP at this time be disruptive, I believe that <br />it would damage the City's position on some of our significant issues. The quality of services <br />received and willingness to put a cap on legal services costs support the recommendation for: <br />COUNCIL APPROVE $550,000 CAP FOR BEST BEST & KRIEGER LEGAL SERVICES <br />FOR FY 1998/99 AND APPOINT AS PERMANENT CITY ATTORNEY FOR THIS <br />PERIOD. <br />
