WARD
STRATEGIC CLAIMS SOLUTIONS
July 23, 1998
Redwine & Sherrill
1950 Market St.
Riverside, CA 92501
Attn.: Mr Jeffry Ferre
Re: West San Bernardino Water District vs. The City of Colton
Dear Mr. Ferre:
D
JUL 2 9 1998
Ward North America is the third party claims administrator for the City of Colton.
CITY OF COLTON
PERSONNEL
Our investigation into the circumstances surrounding the claim you recently presented to the city
on behalf of your client, West San Bernardino County Water District has been completed.
On December 23, 1997 James King, engineering specialist with the City of Colton responded to
your client regarding a letter they sent to the city dated December 8, 1997 concerning a no fee
permit to install 13 )00 feet of 16" transmission line on Valley Blvd. According to Mr King the
city cannot waive the permit fee. Unless the West San Bernardino Water District is under a
special franchise agreement with the City of Colton which states that a no fee permit will be
issued, all permitting fees apply. City records indicate that the Water District is not under such a
franchise agreement. Therefore, by copy of this correspondence to the city, it is our
recommendation that this claim be rejected in its entirety.
Sincerely,
Ward North America
enior Adjuster
CC: JoA=e Knowles
4;21
WARD NORTH AMERICA, INC.
17862 E. 1 7-' S7P ':ET.
