CITY OF COLTON <br />AGENDA REPORT <br />For City Council Meeting of August 18, 1998 <br />TO: Honorable Mayor and Council <br />FROM: Police Department and City Attorney <br />APPROVAL: Henry Garcia, City Manage <br />SUBJECT <br />DATE: <br />TOWING FRANCHISE PROGRAM: <br />, 'I <br />Towing Franchise Regulations (Ordinance No. �-��Adding Chapter 10.40 <br />to the Colton Municipal Code Establishing Tow Truck Franchises and <br />Resolution No. -� �3, 9g Approving the Request for Qualifications) <br />Towing Franchise Agreements (Resolution No. ��'��Awarding Franchise <br />Agreements to Pepe's Towing Service, Inc. and Patriot Towing) <br />August 18, 1998 <br />Background: Aside from Police Department General Order Number 4.130, the City has not <br />established towing service regulations. General Order Number 4.130 provides the Police Department <br />discretion in selecting tow truck operators to provide towing services for the City, on behalf of the <br />Colton Police Department, on a rotation basis. Thus, the Police Department maintains a tow roster <br />of four tow truck operators under the General Order; and vacancies are filled on an "as needed" basis <br />provided the tow truck operator meets certain requirements. The City Council Towing Service Ad <br />Hoc Committee ("Committee"), however, has recommended that it is in City's best interests to adopt <br />more objective criteria for the Police Department to use in selecting tow truck operators. The Ad <br />Hoc Committee also recommended the adoption of a Towing Franchise Program to generate revenue <br />for the City. <br />TOWING FRANCHISE REGULATIONS <br />Discussion: The City Council directed the City Attorney to work with staff to prepare the <br />appropriate ordinance and selection criteria that would allow the City to award towing franchises <br />under franchise program. Under the proposed ordinance, tow truck service candidates are required <br />to meet the following criteria: (1) participate in a public selection process having met or exceeded the <br />selection criteria; and (2) maintain an office and lot in the same location within a ten mile radius of <br />the City's Police Department facility. Among other things, the ordinance limits the number of tow <br />truck franchises to four and requires franchisees to pay the City an amount equal to ten percent of <br />the franchisee's gross revenues attributable to towing and storage services.
