CLARKE, UTILITY DIRECTO <br />SUBJECT: APPROVAL OF CHANGE ORDER NO. 1 IN THE AMOUNT OF $35,000 <br />TO THE CONTRACT WITH KRIEGER AND STEWART FOR THE <br />DESIGN OF THE 2 MGD WWTP EXPANSION AND RENOVATION <br />PROJECT; AND RE -AFFIRM THE BID AWARD TO KRIEGER AND <br />STEWART IN THE AMOUNT OF $700,000 FOR CONSTRUCTION <br />MANAGEMENT <br />DATE: JANUARY 22, 1998 <br />BACKGROUND: <br />On February 5, 1991, Council awarded a two phase contract to Krieger and Stewart to <br />design the addition of two oxidation ditches and secondary clarifiers along with the <br />upgrade of other Wastewater Treatment Plant facilities. In addition Krieger and Stewart <br />were to provide construction management for the project . In 1993, the City ordered <br />the design work to stop. Plans were about 50% complete. On January 16, 1996 the <br />Council authorized staff to negotiate an updated agreement with Krieger and Stewart to <br />complete the preparation of plans and specifications for the repairs and improvements <br />to the Secondary Wastewater Treatment Plant. <br />As Council is aware, on April 7, 1995, the Regional Water Quality Control Board <br />(RWQCB) adopted Cease and Desist Order No. 95-36, ordering the City to make <br />certain improvements to the City's Secondary Wastewater Treatment Plant. As a result <br />of the Cease and Desist Order, the Council and the Utilities Commission moved quickly <br />to determine a course of action to comply with the RWQCB directives. The final <br />decision, made on January 16, 1996 and modified slightly on February 21, 1996, was <br />to authorize Krieger and Stewart to complete the design plans. The Agreement called <br />for completion of the repair and improvement plans for a fee of not -to -exceed $200,000 <br />within a time frame of six months. The time frame was in keeping with the RWQCB <br />approved plans and schedules. Krieger and Stewart performed all of the required <br />design work on time, and the State Water Resources Control Board has approved the <br />plans and specifications for the project and awarded a State Revolving Fund loan to <br />Colton for the construction of the project. <br />Page 1 of 3 <br />
