Countrywide Homes was retained by the City of Colton's redevelopment agency to manage the Rancho Mediterrania property. Gerry Marchese, the on-site manager, is an employee of Countrywide Homes, not the City of Colton. One of Countrywide's respon ibilities is to collect rent and process evictions. At the time of this incident, Countrywide had a written contract with the City of Colton's redevelopment agency as well as a policy of insurance that states in part, Countrywide shall defend, assume all responsibility for and hold the agency (City of C01ton) and its respective officers and employees, harmless from all claims or suits for damages to property and injuries to person, which may be caused by any of the activities of Countrywide under this agreement to the extent the activities of Countrywide are performed negligently, constitute intentional misconduct, or are a breach of the obligations of Countrywide under this agreement whether such activities or performance thereof by Countrywide or anyone directly or indirectly employed or contracted with Countrywide and whether such damage shall accrue or be discovered before or after termination of this agreement." Based on the facts as we know them, it appears that the City of Colton is not responsible for the missing property as stated in your claim and it is our suggestion that you pursue Country-/ide for any recovery you deem necessary. Therefore, by ^opy of this correspondence to the City, it is our recommendation that this claim be rejected in its entirety.
