AGENDA REPORT <br />For Council Meeting of June 2, 1998 <br />TO: <br />Honorable Mayor and Councilme ers <br />FROM: <br />City Attorney <br />SUBJECT: <br />CWA Petition for Unit Modification <br />DATE: <br />June 2, 1998 <br />Background: On November 24, 1997, the Communications Workers of America, Local 9589 <br />("CWA!') filed a Petition for Recognition seeking to represent a separate unit of representation for, <br />Senior Police Clerk, Dispatchers I and H and Records Clerk classifications. Said classifications <br />are currently in the same unit of representation as sworn police . employees. HistoricaUy, these <br />classifications have always been part of the general employees or police unit of representations in <br />the City of Colton. On January 27, 1998, CWA presented their request for a separate unit of <br />representation for these classifications pursuant to Section 10. (A) of City of Colton Resolution <br />No. 2996. <br />Discussion: A separate unit would have an adverse effect on t6 efficient o I peration of the City and <br />sound employee -employer relations by creating yet another level of bargaining and related <br />activities. The City currently has 7 units of representation. A new unit would significantly add to <br />the already substantial administrative workload associated with employee relations. The <br />Ccprincipal criterioW' in the unit determination process is whether there is a community interest <br />among employees. In reviewing Resolution No. 2996, which lists several factors applicable to this <br />determination, said classifications have more similarities than differences with those employees <br />that they were originally included in with the general employees unit of representation. Further <br />review of the Resolution shows no evidence that the freedom to exercise rights under the <br />Resolution is impaired in any way under the status quo. Finally, research indicates that only one <br />city in San Bernardino County (Fontana) has a separate unit of representation for these types of <br />employee classifications. <br />Recommendation: Deny CWA's Petition for Recognition. <br />RVPUB\U-M"W4 <br />Item# 24 <br />
