Appeal <br />Page 2 <br />The applicant requested that this condition be removed and deferred to some unknown future <br />date. The City Engineer, Tim Wilson, GTS Associates, Inc., advised the applicant that the <br />drainage channel should have been constructed when the Rehabilitation (Convalescent) <br />Center was constructed in 1990. The project was (is) a hospital facility, so the State of <br />California was the Responsible Agency for construction monitoring, inspections, and the <br />Certificate of Occupancy. Because of this, the Rehabilitation Center opened without having <br />constructed the drainage channel as required by the City. A copy of the historical <br />documentation on this requirement is attached. <br />DISCUSSION/ANALYSIS- <br />On May 12, 1998, the applicant appealed the Design Review Committee's decision to the <br />Planning Commission, requesting that the drainage channel requirement be removed from the <br />Conditions of Approval, so that they could proceed with construction of the parking lot. They <br />cited the cost of installing drainage as prohibitive. The Planning Commission denied their <br />request, noting that they do not have the authority to override requirements placed on a project <br />by outside departments or agencies, other than those emanating from the Planning Division. <br />The applicant was notified of this decision and was advised that they could appeal the decision <br />to the City Council. <br />ALTERNATIVES: <br />1.) To approve the Appeal and allow the <br />drainage channel requirement. <br />2.) To deny the Appeal and not allow the <br />drainage channel is constructed. <br />FINANCIAL IMPACT: <br />parking lot to be constructed without the required <br />parking lot to be constructed unless the required <br />There may be unknown costs to the City if the drainage channel is not installed in conjunction <br />with the parking lot. Increased run-off will result from construction of the parking lot, which will <br />increase flooding on Reche Canyon Road, downstream from the Rehabilitation Center. Zamoa moo <br />Community Dev ent Director <br />ENVIRONMENTAL IMPACT: <br />There is the potential for increased run-off and increased flooding if the channel is not built. <br />Flooding damages roads and property, so there is the potential for negative environmental <br />impacts if the parking lot is constructed without the drainage channel being installed. <br />
