MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE CITY OF COLTON <br />AND <br />TIGER RESCUE <br />FOR THE DEVELOPMENT AND LEASE OF PROPERTY ON AGUA MANSA ROAD <br />ARTICLE 1: PARTIES AND DATES <br />1.1 This Agreement is entered into in the City of Colton, County of San Bernardino, State of <br />California, this day of 1998, between the City of Colton ("City"), a <br />municipal corporation, and Tiger Rescue, a non-profit organization. <br />ARTICLE 2: RECITALS <br />2.1 Tiger Rescue is a non-profit sanctuary for retired animal performers. Its purpose is to house <br />and care for large non-domestic cats such as lions, tigers, and leopards and other exotic <br />animals. <br />2.2 Without a permanent facility in which to house them, the animals currently cared for by Tiger <br />Rescue will have to be destroyed. Virtually all the animals in Tiger Rescue's care are older, <br />trained, or semi -trained animals. <br />2.3 As of this date, Tiger Rescue is unable to occupy land in Riverside County and comply with <br />zoning requirements. As a result, they are forced to relocate their facility to another suitable <br />location. <br />2.4 The City has vacant, non -dedicated land, which could be made available for the Tiger <br />Rescue relocation. The property is configured and geographically located in such a manner <br />to comport with the needs of Tiger Rescue. <br />2.5 The City can assist Tiger Rescue in effectuating relocation to the City -owned property in <br />Colton. <br />2.6 The purpose of this agreement is to define the respective roles and responsibilities of the City <br />and Tiger Rescue regarding funding, design, and construction of the relocation project. <br />ARTICLE 3: CITY OBLIGATIONS <br />3.1 The City will prepare a lease agreement for approximately six (6) acres on the south side of <br />Agua Mansa Road, commonly known as the old Colton Sewer Plant. <br />3.2 The lease will provide for unencumbered use of the property for the housing and care of <br />exotic animals. <br />3.3 The lease shall include a stated monthly lease rate to be mutually agreed to by the parties <br />and have a term of not less than seven (7) years. Ninety (90) days prior to the end of the <br />initial lease Tiger Rescue may request a two-year (2) extension. Thereafter, two-year <br />extensions may be granted by the City upon written request by Tiger Rescue. <br />3.4 City staff in Community Development will expedite, within their normal functions, any and all <br />applicable entitlements, or other documents, reports and/or reviews to effectuate Tiger <br />Rescue's relocation to the City of Colton. <br />
