C e 1 4, 0 <br />APR 3 0 1998 <br />I <br />CRY OF COLTON � <br />PERSONNEL " <br />Our evaluation reflects that this would be a case of highly questionable or no liability on the part of <br />the City of Colton. Therefore, we recommend that this claim be rejected to commence the statute <br />of limitations. - <br />Based on the information provided, this seems to be an issue of a lack of notice on the part of the <br />City. On October 13, 1997 Ed Gonzalez of the Water Utilities Department responded to a call of a <br />fire hydrant that was hit on 11528 Reche Canyon Road. Mr. Gonzalez was notified by the Colton <br />Police Department that this part of Reche Canyon was in the county, therefore they could not make <br />a report, however, we have now received a copy of the Colton Police Department report written by <br />Office Anthony Garcia Upon arrival at the scene, Mr. Gonzalez noticed that the fire hydrant was shut <br />down and no longer leaking, he was not sure who may have shut down the fire hydrant, perhaps the <br />Fire Department, it was not possible to determine how long the water was running down Reche <br />Canyon Road. <br />According to the police report, a 1992 Pontiac driven by Michael Brletich lost control of his vehicle <br />on a curve, sliding into water that was on the roadway, and hit a parked vehicle, a 1987 Honda A <br />third vehicle, a 1998 Dodge driven by the claimant, Nitaya Puenthong also lost control of her vehicle <br />and slid in the water into the 1992 Pontiac. The cause of the accident was unsafe speed for <br />conditions pertaining to vehicle #1 and vehicle #3. <br />Should there be any questions regarding this matter, please contact me at your earliest convenience. <br />Very truly yours, <br />Ward North America <br />J.
