Garcia, City Manag <br />FROM: Dennis Morris, Human Resource Director't <br />SUBJECT: Resolution to PERS to Determine Industrial Disability Retirement for Police Officer <br />Victor Paul <br />DATE: May 4, 1998 <br />BACKGROUND: On March 25, 1998, Police Officer Paul was declared permanent and stationary by <br />Qualified Medical Examiner Ronald N. Kent, M.D., Ph.D. Primary disabling condition is post traumatic <br />head syndrome and temporomandibular joint syndrome (neurological injury). Based on Dr. Kent's report, <br />Police Officer Paul will be unable to return to his duties as a Police Officer. <br />DISCUSSION/ANALYSIS: Police Officer Paul applied for industrial disability retirement with the <br />California Public Employees' Retirement Systems (CalPERS). Under PERS Law, the City Council or its <br />designee makes the determination as to whether a local safety employee is disabled for purposes of PERS <br />Law and whether such disability or injury is "industrial" within the meaning of such Law. <br />FINANCIAL IMPACT: Advanced Disability Pension payments will be made in the amount of $1,439 <br />per month until retirement benefits are directly received from CalPERS. The first payment for the period <br />May 16, 1998 through May 31, 1998 will be $743.
