Keller <br />Attorney at Law <br />323 W_ Court St. <br />Suite 302 <br />San Bernadino, CA 92401 <br />RE: Our Client City of Colton <br />D/Less May 6,1997 <br />Claimant Luis Rue <br />Dear Mr. Keller. <br />Our investigation into the circumstances surrounding the claim you recently presented to the: City <br />on behalf of your client has been completed. <br />According to the City records, in July of 1996, the RDA Board voted to hire Sterling Enterprises <br />for the sale of mobile homes at Rancho Mediterrania, The agreement was prepared for M e <br />Berg's the then general manager of Sterling Mobile Homes. signature. Although there is a copy <br />of the agreement in the files. the City has been unable to locate a siened copy. <br />in January of 1997, the agency received notification from Pamela hipper informing the City that <br />she was no longer doing business as Sterling Enterprises or Sterling Mobile Home Sales. In <br />March of 1997 the agency received a letter from Mr. Rue's then attorney, Robert J. Stewart <br />informing the City that the partnership, Sterling Mobile Homes between Ms. Lipper and 11vir. Rue <br />was being "unwound" Mike Berg, now representing Suncresst Mobile Homes, requested the <br />agreement be transferred to Suncrest Mobile Homes, as the agreement in question was intended <br />to be with him. Luis Rue contacted the agency informing the City that he was one of the forme; <br />owners of Sterling Mobile Homes, was now doing business as Stertirg Mobile Sales and was <br />entitled to the agreement. <br />In order to resolve the dispute over who had rights to the agreement since there was 1) no signed <br />copy with Sterling Enterprises nor Sterling 141.obile Homes 2) neither party now represented <br />Sterling Enterprises nor Sterling &Mobile Homes and ) the City had received notification that the <br />partnership was being `Zruwound", the matter was taken before the agency hoard for direction. <br />Mr. Rue was notified of the agency's meeting, as is evidenced in his letter dated May 6, 1997. <br />On May 6, 1997, the agency board directed staff to issue an RFP to the project.
