compensation whatsoever to any of the involved employees. The department is not <br />responsible in any manner for hours owed to employees by other employees that leave the <br />employment of the City or are assigned other duties. If one individual fails to appear for the <br />other (regardless of reason), the person who "traded in" will be listed as absent without leave <br />and may be subject to disciplinary action. <br />The City agrees to provide "prorated" insurance contributions for part time employees in the <br />Finance and Public Works Department. <br />7. Conclusiveness of Memorandum of Understanding: The parties acknowledge that during the <br />negotiations which resulted in this MOU, each had the right and opportunity to make demands <br />and proposals with respect to subjects within the scope of representation. The understandings <br />arrived at after the exercise of that right are set forth in this MOU and constitute the complete <br />and total contract between the City and the SBPEA with respect to wages, hours, and other <br />terms and conditions of employment. Accordingly, all wages, hours, and terms and conditions <br />of employment shall remain in full force and effect for the term of this MOU, provided, <br />however, that the parties may, upon mutual agreement, re -negotiate any part or provisions of <br />this MOU during its term. All practices enjoyed by the employees at the present time, which <br />are not included in, or specifically changed by or contradictory to this MOU are subject to <br />meet and confer prior to implementing any proposed change. <br />Any prior or existing Memoranda of Understanding between the parties regarding matters <br />within the scope of representation are hereby superseded and terminated in their entirety. <br />8. SAVINGS CLAUSE: Should any provision of this agreement be held invalid by a court of <br />competent jurisdiction, then the remaining provisions shall remain in full force and effect. <br />9.
