Potential car cruising on Valley Boulevard <br />9. Parking agreements <br />1. Schedule for 18 year-old nights. As of the time this report was written no agreement had been <br />reached on the issue of restricting the number of nights that the Rocks Club will sponsor 18 year-old <br />dance nights. Staff recommended that the applicant agree to hold no more than three such dance <br />nights each week. The applicant will address this issue at the meeting. <br />2. Color of the Rocks Club building. Because the building has gone through the design review <br />process the City may not require the applicant to repaint the building as a condition of obtaining the <br />dance permit. However, the applicant may agree to do so. <br />3. Type 47 License. The City Attorney contacted a representative of the local Alcohol and <br />Beverage Control office in Riverside. ABC has informed us that the Rocks Club has a Title 47 <br />License. This license is a general on sale license for an eating place or restaurant. The license <br />authorizes the applicant to sell beer and wine and distilled spirits on the premises so long as the place <br />is maintained as a bona fide eating place. The business must make actual and substantial sales of <br />meals, during normal meal hours that they are open, at least five days a week. Normal mealtimes <br />must be between 6:00am 9:00am, 11:00am - 2:OOpm; and 6:OOpm - 9:OOpm. Minors are allowed <br />on the premises with this type of license. <br />Basically the Type 47 license is much like a Type 48 license for a bar or night club. Minors may be <br />present with a Type 47 license because the facility serves food. (Copies of information pages from <br />the ABC's website are attached.) <br />Additionally on 3-31-99, Staff questioned a supervisor with the Alcohol Beverage Control if minors <br />could be restricted from the bar area. The ABC Supervisor informed staff that with a type 47 license <br />minors are allowed on the premises and could not be restricted from the bar area. Staff has requested <br />a representative from ABC to be present at the April 6 1999 Council Meeting to address and respond <br />to any specific questions the Council may have regarding the applicants type 47 license. <br />4. Potential drunk driving concerns. The city council's concerns about an increase in drunk <br />drivers leaving the Rocks Club are of course valid concerns. There is no doubt that a few <br />individuals leaving any restaurant or club that sells alcoholic beverages will drive a car away from <br />the business when such people are considered legally intoxicated.
