CITY OF COLTON <br />AGENDA REPORT <br />FOR CITY.' COUNCIL MEETING OF APRIL 6. 1999 <br />TO: HONORABLE MAYOR & CITY CO CIL <br />APPROVAL: HENRY GARCIA, CITY MANAGE <br />FROM: JOHN C. HUTTON, PUBLIC WORKS DIRECTOR <br />SUBJECT: RELEASE OF TEMPORARY CONSTRUCTION EASEMENT <br />DATE: March 22, 1999 <br />BACKGROUND: <br />The present owners of the property located on the northeast comer of Mt. Vernon Avenue and <br />Cooley Drive submitted a request to release any interest, the City may have, in an easement <br />for temporary construction purposes as shown in a deed recorded, January 28, 1977, in Book <br />9109, Pages 1270 to 1273, Official Records of San Bernardino County. This easement affects <br />the southerly thirty-five (35) feet of that property. <br />DISCUSSION: <br />Staff can find no purpose for that easement. It is assumed it was necessary during the <br />construction of the road improvements in the Cooley Ranch Area of the City, as the streets <br />were reconstructed at that time. The title of the document indicates that it is not a permanent <br />condition. <br />FINANCIAL IMPACT: <br />None. <br />ENVIRONMENTAL IMPACT: <br />None <br />RECOMMENDATION: <br />Staff recommends that Council authorize the granting of any interest the City may have by <br />executing the attached deed prior to recordation. <br />JCH/BB/bjw <br />Attachments: Deed <br />Item # 12 <br />Page 1 Of 1- <br />
