R-31-99 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />APPROVING A WAIVER OF TRAFFIC IMPACT FEES <br />IN EXCESS OF $25,000 RELATED TO THE DEVELOPMENT <br />OF THE SPIKES TERIYAKI BOWL RESTAURANT <br />WHEREAS, the City of Colton, California (the "City") is a municipal corporation duly <br />created and existing pursuant to the constitutional laws of the State of California; and <br />WHEREAS, the Redevelopment Agency for the City of Colton (the "Agency"), is a <br />redevelopment agency, a public body, corporate and politic of the State of California, organized <br />and existing pursuant to the Community Redevelopment Law (Part 1 of Division 24) <br />commencing with Section 33000 of the Health and Safety Code of the State of California; and <br />WHEREAS, pursuant to the Redevelopment Plan, the Agency is authorized and <br />empowered to enter into agreements for the redevelopment of real property within the Project <br />Area; and <br />WHEREAS, on September 7, 1993, after a duly notice public hearing, the City Council <br />adopted Ordinance No. R-94-93 establishing a schedule of developer traffic impact fees; and <br />2U WHEREAS, based upon the current traffic impact fee, : the traffic fee assessed for the <br />21 development of the Spikes Teriyaki Bowl Restaurant ("Spikes") has been determined to be <br />22 <br />$202,633.15; and <br />23 <br />24 WHEREAS, on June 17, 1993 the Agency entered into that Restated Development and <br />25 Disposition Agreement with Camden Development (the "Camden DDA), which provided that <br />26 the Agency shall pay or cause the City to waive all Trak Impact Fees in excess of the first <br />27 Twenty -Five Thousand Dollars ($25,000.00) assessed; and <br />28 <br />
