It requires the submittal and approval of a conditional use permit prior to the <br />establishment of a licensed residential or group care facility serving seven or more <br />residents, or an unlicensed residential or group care facility, or a congregate residence <br />with more than 10 occupants. The conditional use permit must be approved by the city <br />council, however the planning commission will be required to hear the matter and make <br />a recommendation on the application to the city council. <br />4. It establishes the findings that must be made prior to approving a conditional use <br />permit. The findings include those contained in Section 18.58.060 of the City's Municipal <br />Code for approval of all conditional use permits, as well as a finding establishing that the <br />proposed use of the dwelling will not constitute a direct threat to the health and safety of <br />other individuals or would not result in substantial physical damage to the property of <br />others. <br />5. Finally, it contains urgency findings evidencing the need to adopt the ordinance <br />as an urgency ordinance, including the potential that future requests would have to be <br />considered without appropriate regulations if the ordinance is not adopted. <br />ALTERNATIVES: <br />The City may decide not to adopt any regulations. The City would then be required to <br />consider such requests without any regulations. <br />FINANCIAL IMPACT: <br />None. <br />ENVIRONMENTAL IMPACT: <br />None. <br />RECOMMENDATION: <br />Staff recommends that the City Council adopt the attached Urgency Ordinance. <br />Report Prepared By: Sonia R.
