GarciXymanage <br />FROM: avi . amonity Development Director <br />SUBJECT: Appeal to the City Council regarding the Planning Commission's Decision to <br />Deny File Index Number DCV -33-99, a Request for an Architectural and Site <br />Plan Review, Environmental Determination, Conditional Use Permit to <br />Establish and Operate a Solid Waste Collection, Processing, Recycling Center <br />and Transloading Facility, and a Major Variance to Permit a Metal Building and <br />to Reduce the Required 25% Landscaping. <br />DATE: <br />August 4, 1999 <br />BACKGROUND: <br />On July 27, 1999, the Planning Commission considered and denied the applicant's request from <br />Taormina Industries, Inc. for a Major Variance to permit a metal building proposed to be located in <br />the Santa Ana River Redevelopment Project Area Specific Plan. <br />After receiving public testimony, the Commission considered and approved the applicant's request <br />with the exception of the Major Variance to permit a metal building. <br />Attached are the Minutes of the Planning Commission Meeting of July 27, 1999 (Attachment A). <br />Upon denial by the Planning Commission, the applicant was informed of the ten-day appeal period. <br />On July 28, 1999, the applicant filed an official appeal of the Commission's denial of a Major <br />Variance to allow a metal building in the Santa Ana River Redevelopment Project Area Specific Plan <br />(Attachment B). <br />DISCUSSION/ANALYSIS: <br />Attached for the Council's review is a copy of the Staff Report (Attachment C) which provided Staff's <br />analysis of the proposed project at the Commission hearing. As noted in the report, under Zoning <br />Consistency, under Section 4.8 of the Santa Ana River Redevelopment Project Area Specific Plan, <br />new building design guidelines require each industrial building to be of masonry block or concrete <br />tilt -up construction. The applicant is proposing to relocate to the project site, an existing metal <br />building (approximately 12,000 squarefeet) to serve as the tipping and processing center. The <br />applicant has agreed to modify the metal building with architectural amenities that will enhance its <br />appearance and compatibility to its surroundings. <br />After receiving public testimony, the Planning Commission determined that the proposed metal <br />building was not consistent with the guidelines of the Santa Ana River Redevelopment Project Area <br />Specific Plan and, therefore, denied the applicant's request of a Major Variance to allow the metal <br />building. <br />ALTERNATIVES: <br />Deny the appeal by the applicant, requiring Taormina Industries to construct an approximately <br />12,000 square foot industrial building of masonry block or concrete tilt -up construction. <br />Item #i <br />
